Terms and Conditions.

General.

1. When you order from us our terms and conditions must be understood, please read the small print. By browsing and purchasing from this website you are agreeing to comply with and be bound by our terms and conditions which together with our privacy policy form our relationship with you through this website.
2. There is no VAT applicable to orders.
3. All sizes given and pictures on the website are intended to be an honest and fair illustration of the actual product but may not be exact. Please allow for variation in monitors resulting in a small difference in colour between those shown on the website and the actual product.
4. We reserve the right without prior notice, to change specifications and/or prices if the product or colours quoted or ordered are unavailable.
5. We reserve the right to substitute materials and/or colours where necessary.
6. We reserve the right to refuse any order without giving any reason whatsoever.
7. All our rosettes carry our name and contact details on the reverse, please do not ask us to remove them.
8. Our rosettes are our own design in particular any centres involving artwork which is our own and as such must not be copied in any way or for any use. This includes all photographs of our products on the website.
9. Safety pins and small items such as diamante stones are used on our rosettes and sashes therefore, please do not allow small children to play with these products. Our rosettes are not toys and as such are unsuitable for handling by unsupervised young children, without risk of injury or choking.
10. Although every effort is made to hold prices, we reserve the right to amend prices where necessary.

Ordering from us.

11. For straightforward orders the standard ranges can be ordered either on line or if you require products made to your own specification via email.
12. For all orders via email, please allow 48 hours for us to get back to you. On receipt of an email stating your full requirements we will send you a quotation, amendments can be made to your order for a further 4 days after which we will email a copy of your final order for approval. Please note orders will NOT be started prior to receipt of your approval by email, and payment in full.
13. All orders except those paid through the website must be paid in full within 48 hours of your email approval. This also applies to all export orders.
14. Depending on how busy we are at the time of your order please allow up to 6 working weeks for your rosettes to arrive. We will endeavour to give you a lead time on our email approval to you at the time your order is placed.

Printing.

15. Any/ all logos or motifs supplied by you to us for printing must be absolutely free of any commercial reproduction restrictions or copyright infringement whatsoever. By uploading material to our website for reproduction you indemnify Deerswood completely against any future claims for any infringements whatsoever. By uploading an image to the Deerswood website you guarantee that you are the legal owner of the copyright of that image, or have been awarded full and unrestricted rights from the copyright owner to upload and utilize the image for the purposes of this website, and for commercial reproduction.

Third Party Rights
By uploading an image, you guarantee that use of the image on the Deerswood website and further reproduction by Deerswood  does not violate the rights of any other party, does not result in a breach of contract between you and another party and that you accept responsibility for any royalties or fees due to any other party from the use of the uploaded image.

Copyright ownership

By uploading an image, you guarantee that any people clearly identifiable within the image have consented to have their image displayed, and reproduced and that you have full rights to use the image in this manner and accept full responsibility for such use.

Responsibility for content

When uploading an image you are solely responsible for its content and for any offence, claims or damages that arise from the content of those images. The approval and posting of images to the site by a  Deerswood representative in no way alters or diminishes your responsibility and does not transfer any responsibility for the content of the image to Deerswood  or the company representative(s) who approve/s the image for posting.

Rights granted to Deerswood

Deerswood does not claim any copyright or any kind of ownership rights to the images you upload to the website. However, by uploading an image to the website you thereby grant to Deerswood full rights to publicly display, copy, reproduce and distribute the image globally on its website, Facebook page, twitter or any other social media linked to our website in perpetuity.

Promotional use of images / no commercial sale of images

Deerswood may select a finished product which includes certain images that you have uploaded to its site to show case for website, social media or promotional brochure use for the sole purposes of a product showcase but will not utilize nor authorize others to utilize such images for other purposes including for sale or for any other forms of financial gain.

Exclusion from Product Showcasing / Promotional advertising.

If you DO NOT wish for your uploaded image(s) to be used on our website or social media links as part of a product showcase please contact us with your request.

Indemnity from claims

You agree to indemnify  Deerswood and its employees and representatives free from any claim or demand made by any third party due to or arising out of your uploading to the Deerswood website of any images or from any violation of any other party’s rights caused by the use of or the content within the images you upload.

16. We reserve the right to charge extra for any unforeseen costs associated with complex printing requirements.
17. Printing dies made up from your artwork for logos/ motifs will incur a one-off charge of £10. Unless complex in which case we will quote a separate price.
18. Tail Printing costs are not included in the standard ranges except for the Cleworth Range where the placing e.g., FIRST, SECOND etc is printed on the central tail in keeping with the design of this rosette, as standard. All other tail prints will be quoted separately in accordance with your requirements.
19. Digital Full colour centres will be as closely colour matched to your requirements as is possible. Please be aware slight variations may be unavoidable.
20. Unless agreed otherwise if you choose gold or silver as the centre print colour then any required tail printing colours will match your choice.

Damages and returns.

• All errors or damage must be notified to us by email with photographs within 4 days of delivery in order that we can address the problem.
• Should you wish to complain please contact us immediately so we can do our best to arrive at a satisfactory outcome.

Delivery.

• From the moment a carrier attempts to deliver the goods they are the Customer's responsibility and the Customer has to accept the goods when they are ready to be delivered.

Returns and Refunds.

Our policy is to take returns where a customer is unhappy with the goods - within 7 days of delivery (or attempted delivery) and a full refund of the purchase price will be made within 30 days of the return subject to the following conditions:

• The customer has contacted us in writing by email within 4 days of delivery or attempted delivery (as above) and provided photographs and a reason for the return.
• The cost of returning the product(s) will be the responsibility of the Customer.
• In all cases for your own protection the goods must be adequately packed in the original packaging to prevent damage.
• Where the Customer has arranged transit the goods must be fully insured.
• The goods must be received by Deerswood in perfect condition, unused and re-saleable.

Damages to orders.

If goods are delivered to you in a damaged condition, we will replace the products free of charge providing we are notified within 4 days of actual or attempted delivery, by email with photographs showing the damage. We have a customer help service available at all times to assist you further in the unlikely event of returns or damages.
